The High Court has confirmed what we already knew was true: it is entirely lawful for service providers to allow trans women to use the women’s toilets – without having to admit cis men.
Put simply, the EHRC’s draft Code of Practice is wrong.
Now, Bridget Phillipson, the Minister for Women and Equalities, will have to send back the EHRC’s draft guidance back to be rewritten.
We need to make sure she does this straight away, before transphobic organisations spin the narrative and force the exclusion of more trans people.
